FujiMuse Terms of Service

1. Acceptance of Terms

By downloading, installing, or using FujiMuse ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

FujiMuse is a mobile application that provides:

• Fujifilm camera recipe management and organization
• AI-powered recipe suggestions and chat assistance
• Visual recipe preview generation
• Social features for sharing photos and recipes
• Recipe synchronization and export capabilities

3. Account Registration

3.1 Requirements

• You must be at least 13 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account

3.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You may not share your account credentials with others

4. Subscription Services

4.1 Subscription Tiers

• Free: Recipe library, community browsing, recipe sharing, on-device recipe previews, and up to 50 saved recipes. AI chat and AI-enhanced previews require a paid plan.
• Pro: 50 AI chat messages and 50 AI-enhanced previews in any rolling 24-hour period, and up to 500 saved recipes. Offered as a monthly subscription ($4.99 per month), a yearly subscription ($29.99 per year, with a 7-day free trial for eligible new subscribers), or a one-time lifetime purchase ($69.99) that unlocks Pro with no renewals.

Daily limits count usage over a rolling 24-hour period. Prices are in US dollars; the store shows the price in your local currency before you buy, and that price applies.

4.2 Billing

• Subscriptions and one-time purchases are billed through the store you bought them from: Google Play for the Android app, or the Apple App Store for the iOS app
• Payment is charged to your store account when you confirm the purchase
• Subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours before the period ends.
• If you start a free trial, you are charged the yearly price when the trial ends unless you cancel at least 24 hours before it ends.
• Prices are shown in the app before you buy and are subject to change with notice
• Refunds are handled by Google Play or Apple under their policies
• If a purchase is refunded, the Pro access it unlocked ends.

4.3 Cancellation

• You may cancel your subscription at any time in your Google Play or App Store subscription settings. Deleting the app or your FujiMuse account does not cancel a subscription.
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods

5. User Content

5.1 Your Content

You retain ownership of content you create and upload ("User Content"). By posting User Content, you grant FujiMuse a worldwide, non-exclusive, royalty-free license to:

• Display, distribute, and reproduce your content within the App
• Use your content for promotional purposes
• Create derivative works for service improvement

5.2 Content Guidelines

You agree not to post content that:

• Infringes intellectual property rights
• Is illegal, harmful, or offensive
• Contains malware or harmful code
• Violates others' privacy
• Is spam or misleading
• Impersonates others

5.3 Content Moderation, Reporting, and Blocking

FujiMuse has no tolerance for objectionable content or abusive users. You can report any post, comment, user, or AI response from within the App, and you can block users so you no longer see their content. Posts and comments reported by several users are hidden automatically while we review them. We review reports promptly and act on objectionable content, which can include removing the content and suspending or removing the account that posted it. We may remove any content that violates these Terms without notice.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's operation
• Reverse engineer or decompile the App
• Use automated systems to access the App
• Circumvent usage limits or rate limiting
• Resell or redistribute the App or its content
• Harass, abuse, or harm other users

7. AI Features

7.1 AI Chat

• AI responses are generated by third-party services through FujiMuse's server-side proxy
• Responses are creative guidance and informational starting points only
• We do not guarantee the accuracy of AI-generated content
• You should verify camera compatibility and settings before applying them

7.2 Preview Generation

• Generated previews are approximations and directional comparisons
• Actual camera results may vary by camera model, firmware, lens, light, JPEG settings, and taste
• Generated images are for personal use within the App

8. Intellectual Property

8.1 Our Property

FujiMuse's own design, code, and original content in the App are owned by FujiMuse and protected by intellectual property laws. This does not include User Content or recipes credited to third-party creators.

8.2 Trademarks

"Fujifilm" and related camera model names are trademarks of FUJIFILM Corporation. FujiMuse is not affiliated with or endorsed by FUJIFILM Corporation.

8.3 Recipe Sharing

When you share a recipe:

• You grant recipients the right to use the recipe
• Attribution should be maintained where provided
• Commercial use restrictions may apply

8.4 Third-Party Recipes and Credits

Some recipes in the App were created by third-party creators, for example Fuji X Weekly. We show each with the creator's name and a link to the original post, and we show recipes from a blog's feed only after that blog has given us permission. Creators' names, blog names, and marks belong to them, and FujiMuse is not affiliated with or endorsed by them. If you created a recipe shown in the App, you can request correction or removal by emailing davey@cleverfoxailabs.com, and we will act promptly.

9. Third-Party Services

The App integrates with third-party services including:

• AI chat services, currently Google Gemini primary and Anthropic Claude fallback
• AI image processing services, currently Replicate for AI-enhanced preview
• Supabase (backend services)
• Google Play Billing and the Apple App Store (payment processing)

Your use of these services is subject to their respective terms and policies.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

11.1 As-Is Basis

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• AI-generated content will be accurate
• Recipe previews will match actual camera output
• The App will meet your specific requirements

11.3 Camera Compatibility

Recipe settings may not be compatible with all Fujifilm camera models. Verify compatibility before applying settings.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to amounts you paid us in the past 12 months
• We are not responsible for any damage to your camera or equipment

13. Indemnification

You agree to indemnify and hold harmless FujiMuse from any claims arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Termination

14.1 By You

You may terminate your account at any time by deleting it in the App under Settings, or by following the steps at fujimuse.app/account-deletion.

14.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our discretion with notice

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends
• Your User Content may be deleted
• Provisions that should survive will continue

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt informal resolution.

15.2 Arbitration

Any disputes will be resolved through binding arbitration, except for small claims court matters.

15.3 Class Action Waiver

You waive any right to participate in class action lawsuits or class-wide arbitration.

16. General Provisions

16.1 Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.

16.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

16.3 Entire Agreement

These Terms constitute the entire agreement between you and FujiMuse.

16.4 Waiver

Failure to enforce any right does not waive that right.

16.5 Assignment

We may assign these Terms. You may not assign without our consent.

17. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified through the App or email.

18. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and FujiMuse only, not Apple. FujiMuse, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to a non-transferable license to use it on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims the App or your possession and use of it infringes their intellectual property rights, FujiMuse, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
